By downloading, installing, or using Sensia IBS Hypnotherapy (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the App.
These Terms form a legally binding agreement between you and the operator of Sensia ("we," "our," or "us"). They are incorporated by reference into our Privacy Policy, which also applies to your use of the App.
Sensia is a self-guided wellness app that provides:
The App is available on iOS via the Apple App Store. Features, content, and availability may change as we develop the product.
Gut-directed hypnotherapy is a clinically studied technique, but individual results vary. Sensia makes no guarantee of symptom relief for any specific user.
You must be at least 13 years old to use Sensia. By using the App, you confirm that you meet this requirement. If you are aged 13–17, you confirm that you have your parent or guardian's permission to use the App and to agree to these Terms on your behalf.
By using the App, you also confirm that you are not barred from using it under the laws of Australia or your country of residence.
To access the full features of Sensia, you will need to create an account. When you do so, you agree to:
We reserve the right to suspend or terminate accounts that violate these Terms.
Certain features of Sensia require a paid subscription. All subscriptions are processed exclusively through Apple App Store in accordance with Apple's billing terms.
We may offer free trials from time to time. Any unused portion of a free trial is forfeited when you purchase a subscription.
You agree to use Sensia only for lawful purposes and in accordance with these Terms. You agree not to:
We reserve the right to suspend or terminate your access to the App if we determine, in our sole discretion, that you have violated these Terms.
All content within Sensia — including but not limited to audio sessions, scripts, graphics, user interface elements, logos, software, and written materials — is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the App solely for your personal, non-commercial self-management purposes. This licence does not include the right to:
You retain ownership of all symptom logs, notes, and other personal data you enter into the App ("Your Content"). By using the App, you grant us a limited licence to store and process Your Content solely to provide the App's functionality to you, as described in our Privacy Policy.
You are responsible for ensuring that anything you enter into the App is accurate and does not infringe the rights of any third party.
Sensia uses third-party services including Supabase (data storage), Apple App Store (subscriptions), and RevenueCat (subscription management). Your use of the App is also subject to the applicable terms and policies of these third parties. We are not responsible for the acts or omissions of third-party service providers.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
Nothing in these Terms limits or excludes any guarantees, warranties, rights, or remedies that you may have under the Australian Consumer Law, which cannot be excluded by contract.
To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or in connection with your use of the App, including but not limited to loss of data, loss of profits, or personal injury.
Our total aggregate liability to you for any claims arising under or in connection with these Terms will not exceed the total amount you paid to us (if any) in the 12 months preceding the claim.
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
You agree to indemnify and hold harmless Sensia and its operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the App or your violation of these Terms.
We may suspend or terminate your access to the App at any time, with or without notice, for any conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the integrity of the App.
You may stop using the App at any time and delete your account as described in our Privacy Policy. Termination does not entitle you to a refund of any subscription fees already paid, except as required by law or Apple's refund policy.
Sections 3, 8, 11, 12, 13, and 15 of these Terms survive termination.
These Terms are governed by the laws of Australia. For users in Australia, any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Australia.
If you are located outside Australia, local mandatory consumer protection laws in your jurisdiction may also apply. We will always seek to resolve disputes informally in the first instance. Please contact us at sensia.support@gmail.com before initiating any formal dispute process.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will provide notice through the App or by email (where we hold your address). Continued use of the App after the effective date of an update constitutes your acceptance of the revised Terms.
